§ 2. Area of Applicability
These terms and conditions are applicable to all sales and contracts for only the materials listed on this website and beginning at the time of purchase. Any contradictions to these terms and conditions brought forward by the customer will be denied unless otherwise alternative arrangements can be proven from written documentation from both parties. Customers who choose to accept our service(s) or order our product(s) agree to our terms and conditions; acceptance of our terms and conditions is a condition of purchase. The same adherence applies to those who enter nonstandard written agreements. By clicking on “buy now”, you agree to our terms and conditions. An order confirmation will be sent after placing your order, forming the contract of purchase.
§ 3. Quality Warranty
We offer a five year quality warranty, starting on the date of purchase. We cannot be held liable in cases of vandalism or irregular handling and care.
§ 4. General Shipping Policy
Unless otherwise specified, shipments will be delivered from the warehouse to the address provided by the customer at the time of purchase. The delivered product remains the property of BIKEHOME until paid in full, regardless of if the time for right of withdrawal has expired or not.
§ 5. Right of Withdrawal
It is possible to return the product within two weeks after receipt of the product. If returned within two weeks the customer is no longer responsible for payment. The product(s) can be returned without stating a reason during this two week period and must be accompanied with written (for example via letter, fax or another data form) communication, returned via registered mail with proof of mailing. The deadline begins on the date of purchase. In the case of revocation we will return all payments and the buyer is obligated to send back already supplied goods if this was not yet settled in connection with the revocation letter. Shipping costs (transport and packaging) as well as other costs associated with the return of the product are the responsibility of the buyer. A return can only happen if the unused product is returned in the original packaging. After the product has been fully assembled it is not possible to return.
§ 6. Payment
If the product is ordered with advance payment, we will ship the product as soon as the payment has been credited to our account. The payment should be sent two weeks at the latest after the date on the receipt. If the product is ordered via PayPal it will be sent immediately after the receipt of payment on our account.
§ 7. Ownership
The product delivered from us remains the property of BIKEHOME until the customer has paid in full.
§ 8. Customer Responsibility for the Selected Orders
The customer is obligated to double check all information before sending their order. We are not responsible for orders containing errors. In particular the customer should pay attention to their payment option and the number of product(s) to be ordered.
§ 9. Data Protection
We follow all legally-required forms of data security and protection. The only personal data which will be collected is that which is required to successfully carry out an order. The customer agrees upon purchase that this data will be used and saved by BIKEHOME. No personal data will be transferred to third parties. A transfer of data to a third party is only possible with explicit customer approval.
§ 10. Applicable Law and Place of Jurisdiction
The contract language is German. German law is exclusively valid, excluding UN commercial sales laws. The place of jurisdiction is Grünstadt.
§ 11. Ambiguity Rule
If individual provisions of these contractual conditions should be invalid, the remaining provisions are not affected.[:]
